When You Receive Your Order
Upon receipt the package should be opened promptly, and material checked against the packing slip enclosed. Items out-of-stock at time of shipment will be marked as back-ordered. If an item is missing and not marked backordered, or if any items are incorrect please contact us immediately.
Returns
All hose assemblies purchased on aircrafthosestore.com are custom made per customer specifications. No return material will be accepted without written consent and a valid Return Material Authorization (RMA). Return material will not be accepted after 30 days from original receipt by customer. All returns for any reason other than warranty issues may be subject to a restocking fee. SHAC has no obligation to accept a return for any assembly ordered incorrectly and restocking fees are solely at the discretion of SHAC. Freight for returned materials is the responsibility of the buyer.
All components sold on aircrafthose.com carry a one-year manufacturer warranty. Specialty Hose Aerospace Corporation will repair or replace products which are defective due exclusively to flaws in materials or workmanship within twelve (12) months from date of shipment and upon return of the material at the Buyer’s expense.
Any products which have been subject to an accident or damage caused by any negligent act or omission or circumstances beyond the reasonable control of SHAC void any warranty claim. Product that the buyer has subjected to misuse or abuse in its operation, storage, maintenance or management voids any warranty. All material is warranted by Eaton Corporation and is also subject to the Eaton Aerospace, North America Terms and Conditions.
Except for the express warranty as described above, there are no warranties, including any implied warranties as merchant-ability or fitness for any particular purpose which extend beyond the description of the products on the face hereof. No warranties or representations at any time made by any representative of Specialty Hose Aerospace Corporation shall be effective to vary or extend the above referenced Express warranties or any other terms thereof.
Before returning any product, contact Specialty Hose Aerospace Corporation as an RMA (Return Merchandise Authorization) number and return shipping instructions are required to process a return. Submitting an RMA request does not automatically constitute authorization. This can be done by calling (330) 497-9650 or by emailing QC@specialtyhose.com with reference information including order number, customer name and address, what needs to returned, and valid reason for return.
Intended Use of Products
It is the responsibility of those desiring to install parts purchased from Specialty Hose Aerospace Corporation on an aircraft to determine that the installation of the part will not cause the part to be subjected to conditions of which it has not been approved. Any parts supplied by Specialty Hose Aerospace Corporation may only be installed in a manner acceptable to, and approved by, the FAA Administrator.
Cancellation or Changes of Orders
No orders may be withdrawn or cancelled by the Buyer, nor may they be deferred when ready, unless Specialty Hose Aerospace Corporation shall first be paid a cancellation or deferral charge of a reasonable amount acceptable to Specialty Hose Aerospace Corporation. In the event Buyer shall request changes in its order after receipt thereof by Specialty Hose Aerospace Corporation, assessment of such changes shall be done by Specialty Hose Aerospace Corporation and accepted or denied at the sole discretion of SHAC.
Certificate of Conformance and Form 8130 (Export)
Specialty Hose Aerospace Corporation provides you with a standard certificate of conformance for our TSO products at no charge. 8130 Forms are available for most parts if indicated in order notes during the purchasing process on www.aircrafthosestore.com. If available, the forms must be requested at time of order and in some cases the product must be special ordered from the factory with the forms. These forms cannot be furnished after you receive the product. An 8130 form request may affect the shipping schedule for your order. Due to delays and costs involved in furnishing these forms, we strongly suggest that you check to see if the standard Specialty Hose Aerospace Corporation Certificate of Conformance will be acceptable in lieu of Form 8130.
Cutting Charges for Bulk Hose and Firesleeve
Certain orders for specific lengths of bulk materials may incur an additional cutting charge. Nearly all our cut material orders are shipped with no additional charges, however, should your order warrant a cutting charge, you will be contacted with an explanation and request for approval. If approved, we will proceed with the order and if it is not approved, we will provide alternative solutions. Orders without specific length requirements will be shipped as material is stocked with no minimum length requirement. All bulk lengths are subject to a +/- 10% quantity variance.
Taxes and Duties
All taxes, dues, import/export duties, etc., shall be the sole responsibility of the customer. Sales tax shall only be collected from customers in the state of Ohio.
Delivery
All domestic orders are defaulted to ship and back order but will be shipped in full so long as all components are in stock. International orders will only ship complete unless otherwise requested in notes or confirmed via another communication. All freight, duty, customs charges, fees, and/or licenses associated with import/export are the responsibility of the customer. If Specialty Hose Aerospace Corporation is billed these charges on your behalf, you hereby agree that you will be billed by Specialty Hose Aerospace Corporation for these charges. Any dates or schedules which may be specified for the delivery of the products covered herby have been stated only approximately and are estimated from the date of receipt of Buyer’s order. Specialty Hose Aerospace Corporation shall not incur any liability, either direct or indirect, nor shall any order be cancelled because or as a result of any delays in meeting such dates or schedules.
Force Majeure
Specialty Hose Aerospace Corporation shall not be responsible or liable for any delays or failures in manufacture, or delivery due to any cause or condition beyond the control of Specialty Hose Aerospace Corporation, including, without limiting the generality of the foregoing, strikes or other labor riots, or other civil commotion and war.
Law, Ordinances and Regulations
Specialty Hose Aerospace Corporation shall utilize reasonable efforts to cause products manufactured or designed by it to comply with its interpretation of federal safety regulations and insurance codes of a national scope. However, SHAC shall not be responsible for compliance with local interpretation of federal safety regulations or insurance codes, nor with any local laws, ordinances, codes and/or regulations which may at any time be in effect with respect to the products, unless such responsibility shall be expressly assumed by Specialty Hose Aerospace Corporation in writing. Further, Specialty Hose Aerospace Corporation shall have no responsibility whatever for compliance with such laws, etc, by products manufactured or designed by others.
Some commodities sold on aircrafthosestore.com may be subject to Export Administration Regulations (EAR) and/or International Traffic in Arms Regulations (ITAR). Any parts purchased for resale outside of the United States must be shipped only in accordance with the applicable US export laws and regulations and it is the sole responsibility of the Buyer and the Buyer’s agents to comply with the laws, Buyers and Buyer’s agents are not to cite Specialty Hose Aerospace as an exporter on any export documents.
Liability Limitation
In no event shall Specialty Hose Aerospace Corporation be liable for consequential, incidental or special damages resulting from or in any manner relating to the products, their design, use or any inability to use the same, including, without limitation, damages arising out of or in any manner relating to the delivery of the products or any delay with respect to their delivery, it being understood that the sole and exclusive remedy with respect to defective products manufactured by it shall be the repair, correction, or replacement thereof pursuant to the WARRANTY provisions herein-above contained. Should the products prove so defective, however, as to preclude the remedying of warranted defects by repair or replacement, the Buyer’s sole and exclusive remedy shall be the refund of the purchase price of the defective products involved upon the return of the products to SHAC.
No Protection from Claim of Infringement
Specialty Hose Aerospace Corporation makes no representation or warranty that the delivery or subsequent use of the products ordered shall be free of the claim of any third party by way of infringement.
Applicable Law
The terms and conditions applicable to the transaction provided for herein shall be determined and construed in accordance with and shall be governed by, the laws of the State of Ohio, and Buyer and SHAC agree to submit to the jurisdiction of the appropriate State or Federal Court within Ohio for purposes of resolving any dispute or claim arising in connection with said transaction.
Title and Risk of Loss
All sales are made F.O.B. shipping point. Company’s title and risk of loss pass to Buyer and company’s liability to delivery of products purchased to the carrier at shipping point, the carrier acting as Buyer’s agent. Unless Company receives instructions from Buyer specifying which method of shipment to be used. Company will exercise its own discretion. Freight charges, export and import duties, and insurances during and after transit are Buyer’s sole responsibility.
